“We” reserve the right to change or update the Terms of this Usage Agreement, including our Privacy Policy, and post notice of any modifications, alterations or deletions at any time. Such notice shall become effective upon posting on the “Web Site”. All continued use of this “Web Site” shall be deemed to be your acceptance of any/all modifications. Open House Express LLC reserves the right to suspend or discontinue any aspect of the service provided on this “Web Site” at any time without notice or liability, including the availability of any feature, database or content.

Any suit brought to interpret or enforce the terms and conditions of this Terms of Use Agreement shall be brought in the state or federal courts that have jurisdiction and any awards on behalf of Open House Express LLC (Oregon Open House Online) will grant reasonable attorney’s fees, costs, and litigation expenses associated with such on the behalf of Open House Express LLC (Oregon Open House Online). You agree that the entire liability of Oregon Open House Online, its’ affiliates or licensees arising out of any kind of legal claim arising out of or otherwise related to this Web site will not exceed the amount you paid for advertising costs.

LINKS TO REAL ESTATE BROKERS AND OTHER BUSINESS WEBSITES ~ The “Web Site” offers users interested in viewing open houses the ability to link or connect with a local real estate brokers/agent (collectively). While “We” seek confirmation from each Real Estate Broker/Agent that it is licensed and qualified to provide Real Estate Services, Oregon Open House Online does not and cannot represent, warrant or guarantee any service, quality of performance or complete current and accurate information provided by each Real Estate Broker/Agent. It is recommended that all buyers and/or users of this website take appropriate steps to conduct background checks before visiting any open house or other property listings posted and/or meeting with any of the parties listed on this website as agents, buyers or other users, including but not limited to those who have been notified of information on this web site by any other 3rd party.

NON-OPEN HOUSE LISTINGS ~ Brokers may upload active Property Listings that are not currently scheduled for an Open House into their accounts at any time making it easy to schedule an Open House for the property at a future date. Agents may select to display non scheduled active Property Listings among the scheduled Open House Listings with a message asking interested viewers to contact Listing Agent to schedule a showing. *** EASY PROPERTY LISTING AND OPEN HOUSE AD PLACEMENT GUIDELINES ARE AVAILABLE IN YOUR FREE ACCOUNT.

OPEN HOUSE AD PLACEMENT AND CANCELLATION POLICY ~ Brokers/Agents may submit Open House Ad(s) at anytime. Open House Ads will be displayed until midnight the day of the scheduled Open House. If for any reason a scheduled open house needs to be cancelled, the Broker/Agent may log back into the site and select “Cancel Open House”, which will upload the word “Cancelled” onto the cancelled Open House listing.

AGENT/BUSINESS NETWORK LINK ADS ~ Oregon licensed Real Estate Agents and Offices may elect to purchase a “Business Network Link Ad“ at anytime. All “Other Businesses” wanting to advertise must be pre-approved by Oregon Open House Online through email confirmation. Placement of “Other Business” ads without email verification of approval from Oregon Open House Online shall be subject to immediate removal from the “Web Site” with no recourse for reimbursement of any kind. The “Web Site” reserves the right to determine the compatibility of “Other Business” advertisers on the website. “Other Business” advertising is defined as all advertising excluding licensed Real Estate Professionals and Real Estate Offices.

ALL AD PLACEMENT SALES ARE FINAL ~ Agent/Businesses may elect to cancel their Business Network Link Ad at any time however ads will continue to be viewed on line through the end of their pre-paid period. ---

BUSINESS NETWORK LINK AD BILLING ~ All credit card billing will reflect payment charges by Open House Express, LLC. on your monthly billing statements.

TERMINATION OF SERVICE ~ You understand and agree that at Oregon Open House Online’s sole discretion and without prior notice may for any reason cease to do business. All advertisers will be notified on line and any recurring billing accounts will cease. Oregon Open House Online and it’s advertisers will continue to be viewed online through the end of all Agent/Business ads pre-paid time.

VIEWER INFORMATION ~ Viewers do not have to sign in to use the web site. Therefore we do not collect any Viewer information other than Advertisers. The web site is designed to get viewers out to the Open Houses to meet you. We do not (and can not) collect any viewer information to pass onto other agents, etc..

LICENSING ~ The owner of The Open House Express LLC (Oregon Open House Online) is a licensed Real Estate Agent in the State of Oregon. All Property listings are handled by licensed Real Estate Brokers/Agents who act on the behalf of said Principal through a separate employment contract.
